Auto Count Sdn Bhd (“ACSB”), a Malaysian private limited company, is committed to protecting your privacy. This Privacy Policy sets out ACSB’s policy with respect to our collection, use, and disclosure of information, with respect to your access and use of our Service through AutoCount Payroll’s online software application and website operated by ACSB. Please review this Privacy Policy for the Service and website carefully. Your use of the Service and website signifies your agreement to this policy. If you do not agree with this policy, do not access and use our Service, website or applications.


1.      What Information We Collect About You


Our goal is to collect and use only the information that we think is required for our legitimate business interests, in order to better understand your interests and to improve your experience of using our Service and website. In order to do so, we collect the following types of information:


(a)   Personally Identifiable Information


Personally Identifiable Information is any information that identifies a living individual, such as your first and last name, mailing address, phone number, email address, credit/debit card number and expiration date (or other payment-method information), login ID, user name and password and other information about a specific individual that identifies the individual (collectively, "Personally Identifiable Information").


There are a number of situations in which your Personally Identifiable Information may help us give you better service. For example, we may ask for your Personally Identifiable Information when you are signing up for or using our online Service participating in an online survey and etc. At such times, we may collect Personally Identifiable Information relevant to the situation such as your name, mailing address, phone number, email address and contact preferences, your credit card information, and information relating to a support issue.


We collect information for market research purposes, such as your occupation and where you use your computer, to gain a better understanding of our customers and thus provide more valuable service. We also collect Personally Identifiable Information that you may voluntarily provide when you use our Service and website or that you may disclose in a public area of our website (such as a message board or chat room). We also may obtain Personally Identifiable Information from reputable third parties, such as credit agencies.


(b)   Non-Personally Identifiable Information


We collect information from you automatically when you use our Service and website. This helps us to determine how best to provide useful information to customers and to understand which parts of our Service and website are of most interest to them. Non-Personally Identifiable Information is information that does not specifically identify a living individual and is not used with Personally Identifiable Information to determine an individual's identity, including a computer's Internet Protocol ("IP") address, a mobile device's unique identifier, computer and device connection information such as browser type or version, demographic information such as a person's age, ZIP code and other data collected automatically through the operation of our Service and website (collectively, "Non-Personally Identifiable Information").


We may collect site usage data and other Non-Personally Identifiable Information (such as which website pages are visited and in what sequence) through the use of various technologies. For example, our web servers automatically collect IP addresses from computers and other devices that visit our website. An IP address is a number that is automatically assigned to a computer by the Internet service provider whenever the computer is connected to the Internet. Web servers, the computers that "serve up" and deliver web pages, automatically identify a computer by its IP address, and when a page is requested from a website, its servers log the IP address of the computer requesting the page. When we are collecting information regarding what pages and content on our Service and website a computer is accessing and using, in general we do not link that computer's IP addresses to any Personally Identifiable Information. Although the website usage data associated with a computer's IP address will be logged, your identity will remain anonymous to us and the Service and website.


For portions of our Service and website that may require registration or a log-in, we may also collect your registration, username and password information from you when you register or log in to those portions of our Service and website. During some visits, we may use software tools, such as Javascript, to measure and collect session information, including page response times, download errors, time spent on certain pages, page interaction information and methods used to browse away from the page.


2.      Cookies and Other Technologies


Like standard practice on many other corporate websites, our website uses "cookies" and other technologies. A cookie is a small text file that is sent to your computer from a web server and stored on your computer's hard drive when you visit a website. Our cookies contain Personally Identifiable Information, such as your login ID and your email address, as well as Non-Personally Identifiable Information. We use cookies and other technologies to help us understand which parts of our website are the most popular, where our visitors are going, and how much time they spend there. We also use cookies and other technologies to make sure that our online advertising is bringing customers to our Service. We use cookies and other technologies to study traffic patterns on our website, to make it even more rewarding as well as to study the effectiveness of our customer communications. Furthermore, we use cookies to customize your experience and provide greater convenience each time you interact with us.


Most browsers are initially set to accept cookies. If you prefer, you can set your browser to refuse cookies or to alert you when cookies are being sent, but it is possible that some parts of our Service and website may not function properly if you do so. Certain Internet browsers, such as Internet Explorer, Chrome, Firefox and Safari, also allow you to block, control and remove cookies from your computer. Your continued use of our Service or access of our website serves as your consent to the placement of cookies in your browser in accordance with this Privacy Policy.


Like most of the websites, we gather certain information automatically and store it in log files. This information includes IP addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and click-stream data. We use this information, which does not identify individual users, to analyze trends, to administer the site, to track users' movements around the site and to gather demographic information about our user base as a whole. We will not use the information collected to market directly to that person.


In some of our email messages, we may use a "click-through URL" linked to content on our website. When a customer clicks one of these URLs, they pass through our web server before arriving at the destination web page. We track this click-through data to help us determine interest in particular topics and measure the effectiveness of our customer communications. If you prefer not to be tracked in this way, simply avoid clicking text or graphic links in the email.


In addition, we may use pixel tags (which are tiny graphic images), web beacons or similar mechanisms (collectively, "Pixel Tags") to obtain certain usage information regarding our Service and website. When you visit a page on our website that contains a Pixel Tag, the Pixel Tags communicate with your computer to collect Non-Personally Identifiable Information and determine, among other things, whether you have been to that page before or viewed a particular advertisement. We use Pixel Tags to tell us what parts of our website customers have visited or to measure the effectiveness of searches customers perform on our website.


Pixel Tags also enable us to send email messages in a format which customers can read. In addition, they tell us whether emails have been opened to assure that we are only sending messages that are of interest to our customers. Pixel Tags can be refused when delivered via email. If you do not wish to receive Pixel Tags via email, you will need to disable HTML images or refuse HTML (and select text only) emails via your email software. Although these mechanisms are similar to cookies, they are different in that they are not stored on your computer and, therefore, cannot be disabled through your browser.


3.      How We Use Information We Collect


How we use the information we collect depends in part on the Service you use, how you use them, and any preferences you have communicated to us. Below are the specific purposes for which we use the information we collect about you:


(a)   Account Registration


We may use your name, phone number, and email address to register your account for the Service we provide and to communicate important information to you. We may obtain additional Personally Identifiable Information about you, such as address change information, from commercially available sources, to keep our records up to date. If you set up an administrator account that may be accessed by people other than you, please note that they may see and have the ability to change or delete your Personally Identifiable Information.


(b)   For Research and Development


We are always looking for ways to make our Service and website smarter, faster, secure, integrated, and useful to you.  We use collective learnings about how people use our Service and website, and feedback provided directly to us to troubleshoot, and to identify trends, usage, activity patterns and areas for integration and improvement of the Service and website. In some cases, we apply these learnings across our Service and website to improve and develop similar features or to better integrate the Service and website you use. We also test and analyze certain new features with some users before rolling the feature out to all users.  


(c)   To Communicate with you About the Service


We use your contact information to send transactional communications via email or other means, including confirming your subscription, reminding you of subscription expirations, processing billing and payment, responding to your comments, questions and requests, providing customer support, and sending you technical notices, updates, security alerts, and administrative messages.  We also provide tailored communications based on your activity and interactions with us. These communications are part of the Service and in most cases, you cannot opt out of them. If an opt out is available, you will find that option within the communication itself or in your account settings.


(d)   To Market, Promote and Drive Engagement with the Service


We use your contact information and information about how you use the Service to send promotional communications that may be of specific interest to you, including by email and by displaying our advertisements on other companies’ websites and applications, as well as on platforms like Facebook and Google.  These communications are aimed at driving engagement and maximizing what you get out of the Service, including information about new features, survey requests, newsletters, and events we think may be of interest to you. We also communicate with you about new products and services offer, promotions and contests. You can control whether you receive these communications as described below under the setting section of the Service in use.


(e)   Customer Support


We use your information to resolve technical issues you encounter, to respond to your requests for assistance, to analyze crash information, and to repair and improve the Service and website.


(f)    For Safety and Security


We use information about you and your Service use to verify accounts and activity, to monitor suspicious or fraudulent activity and to identify violations of Service policies.


(g)   To Protect Our Legitimate Business Interests and Legal Rights


Where it is required by law or where it is necessary to protect our legal rights, interests and the interests of others, we use information about you in connection with legal claims, compliance, regulatory, and audit functions, and disclosures in connection with the acquisition, merger or sale of a business.  


4.      How We Share and Disclose Information We Collect


We make collaboration tools, and we want them to work well for you. We will only share information that we collect about you in the ways described below, including in connection with possible business transfers, but we are not in the business of selling information about you to advertisers or other third parties:


(a)   Service Providers


We work with third-party service providers to provide website and application development, hosting, maintenance, backup, storage, virtual infrastructure, payment processing, analysis and other services for us, which may require them to access or use information about you.  If a service provider needs to access information about you to perform services on our behalf, they do so under strict instruction from us, including policies and procedures designed to protect your information.


(b)   Links to Third Party Sites


The Service may include links that direct you to other websites or services whose privacy practices may differ from ours. If you submit information to any of those third-party sites, your information is governed by their privacy policies, not our privacy policy. Thus, we strongly encourage you to carefully read the privacy policy of any website you visit.


(c)   Third-Party Widgets


Our website may contain widgets and social media features, such as the Twitter “tweet” button. These widgets and features collect your IP address, which page you are visiting on the Service, and may set a cookie to enable the feature to function properly. Your interactions with these features are governed by the privacy policy of the company providing it.


(d)   With Your Consent


We share information about you with third parties when you give us consent to do so. For example, we often display personal testimonials of satisfied customers on our public websites. With your consent, we may post your name alongside the testimonial.


(e)   Compliance with Enforcement Requests and Applicable Laws; Enforcement of Our Rights


In exceptional circumstances, we may share information about you with a third party if we believe that sharing is reasonably necessary to:


i.        comply with any applicable law, regulation, legal process or governmental request, including to meet national security requirements;

ii.      enforce our agreements, policies and terms of service;

iii.    protect the security or integrity of our products and services;

iv.    protect ACSB, our customers or the public from harm or illegal activities; or

v.      respond to an emergency which we believe in good faith requires us to disclose information to assist in preventing the death or serious bodily injury of any person.


(f)    Our Policy on Responding to Law Enforcement Requests


We provide software tool for teams to collaborate in an online platform environment. These guidelines provide information to inform law enforcement officials seeking customer account records and customer content (“Customer Information”) from us in response to valid legal process, consistent with our Terms and Conditions and Privacy Policy. We respect the rules and laws of the jurisdiction in which it operates, as well as the privacy and rights of its customers. Accordingly, we provide Customer Information in response to law enforcement requests only when we reasonably believe that we are legally required to do so. To protect our customers’ rights, we carefully review requests to ensure that they comply with the law.


To obtain Customer Information from us, law enforcement officials must provide legal process appropriate for the type of information sought, such as a subpoena, court order, or a warrant. For example, we will not provide non-public customer content unless served with a valid search warrant, issued on a showing of probable cause by a federal or state court authorized to issue search warrants, which require us to disclose the content. Please review these guidelines before submitting a law enforcement request to us.


These guidelines are intended to serve as an informational resource and do not create obligations or waive any objections concerning how we will respond in any particular case or request, to reserve the right to seek reimbursement for the costs associated with responding to law enforcement data requests, where appropriate.


i.        user Notice Policy


Our policy is to notify customers of requests for their information and provide them with an opportunity to object to the disclosure 7 to 14 days prior to production, unless such notification is prohibited by law. We may shorten the notice period, at our absolute discretion, but generally only does so in emergency situations. Law enforcement officials who believe that notification would jeopardize an investigation should obtain an appropriate court order or other process that specifically prohibits customer notification, such as an order issued under applicable law.


Further, if your request place us on notice of an ongoing or prior violation of our Terms and Conditions, we will take action to prevent further violation, including account termination and other actions that may notify the user that we are aware of the misconduct. If you believe in good faith that taking such actions will jeopardize an ongoing investigation, you may request that ACSB defer such action in your request. We will evaluate such requests on a case-by-case basis. It is the responsibility of the requesting law enforcement official to make this request, as it is our policy to enforce its Terms and Conditions.


ii.      Serving a Valid Law Enforcement Request


While we agree to accept service of law enforcement requests to us through a reasonable communication, neither us nor our customers waive any legal rights based on this accommodation. Each request must include contact information for the authorized law enforcement agency official submitting the request, including:


·         Requesting agency name;

·         Requesting agent name and badge/identification number;

·         Requesting agent employer-issued email address;

·         Requesting agent phone contact, including any extension;

·         Requesting agent mailing address (P.O. Box will not be accepted); and

·         Requested response date (see details below for emergency requests)


Please note that requests seeking testimony must be personally served on our registered agent for service of process. We do not accept such requests in person or via email.


iii.    Available ACSB’s Customer Information


We offer a variety of software tools on its platform that contain Customer Information. In addition, we maintain certain Customer Information in internal systems as a matter of regular business processes. We will review and respond to requests for Customer Information pursuant to a valid, enforceable government request, court order and/or warrant, depending on the type of information requested.


The categories of Customer Information that may be available for law enforcement requests seeking basic customer account information, include, for example, email address, name, phone number, screen name, instant messenger ID and/or billing contact information (in connection with paid accounts). Additional information regarding IP addresses, geolocations, transactional records and other customer records may be available.


·         Law Enforcement Preservation Requests


We will preserve Customer Information for 90 days upon receipt of a valid law enforcement request. We will preserve information for an additional 90-days period upon receipt of a valid request to extend the preservation. If we do not receive formal legal process for the preserved information before the end of the preservation period, the preserved information may be deleted when the preservation period expires.


Preservation requests must be sent on official law enforcement letterhead, signed by a law enforcement official, and must include:


-          The relevant account information identified below for the customer whose information is requested to be preserved;

-          A valid return email address; and

-          A statement that steps are being taken to obtain a court order or other legal process for the data sought to be preserved.


Preservation requests may be sent to us to our contact information which is stated in this Privacy Policy.


iv.    How to Request ACSB’s Customer Information


When requesting Customer Information, law enforcement requestors should provide as much of the following information as is available. Providing the basic customer account information such as user name, email address, URL and etc. will facilitate our ability to respond in an effective and timely manner.


v.      Emergency Requests


We evaluate emergency requests on a case-by-case basis. If you provide information that gives us a good faith belief that there is an emergency involving imminent danger of death or serious physical injury to any person, we may provide information necessary to prevent that harm if we are in a position to do so, consistent with applicable law.


(g)   Information Sharing between ACSB’s Entities


We share your information, including your Personally Identifiable Information, with and among our affiliates and subsidiaries, except where prohibited by law. Affiliates and subsidiaries means companies related by common ownership or control. The reasons why we share your information include for our everyday business purposes, such as to process your transactions, maintain your accounts, operate our business, and etc. We will also share your information in order for us to be able to offer our Service to you. We may also share information about your creditworthiness, your transactions and experience so that we can operate our business effectively, detect and prevent fraud, and improve our Service.


(h)   Reporting to Credit Bureaus


We may share your information with credit bureaus, consumer reporting agencies, and card associations. Late payments, missed payments, or other defaults on your account may be reflected in your credit report and consumer report. We may also share your information with other companies, lawyers, credit bureaus, agents, government agencies, and card associations in connection with issues related to fraud, credit, or debt collection.


(i)     Business Transfers


We may share or transfer information we collect under this Privacy Policy in connection with any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company. You will be notified via email and/or a prominent notice on the Service if a transaction takes place, as well as any choices you may have regarding your information.


5.      How We Store and Secure Information We Collect


(a)   Information Storage and Security


We use a server to store the information within the Service, and we use technical measures to protect against loss, misuse and authorized alteration of the information under our control. More specifically, we use Secure Sockets Layer (SSL) encryption when collecting or transferring sensitive information such as credit card information and etc. Please take note that the server that makes our website or the Service available may be located outside the country from which you have accessed. All providers are bound by an agreement that ensures a high standard of privacy protection and requires (amongst other provisions) that it act only on our instructions and implements all technical measures necessary on an ongoing basis to keep your personal information secure. However, no security system is impenetrable and due to the inherent nature of the Internet, we cannot guarantee that data, during transmission through the Internet or while stored on our systems or otherwise in our care, is absolutely safe from intrusion by others.


(b)   How Long We Keep Information


How long we keep information we collect about you depends on the type of information, as described in further detail below.  After such time, we will either delete or anonymize your information or, if this is not possible (for example, because the information has been stored in backup archives), then we will securely store your information and isolate it from any further use until deletion is possible.  


i.        Account Information


We retain your account information for as long as your account is active and a reasonable period thereafter in case you decide to re-activate the Service.  We also retain some of your information as necessary to comply with our legal obligations, to resolve disputes, to enforce our agreements, to support business operations, and to continue to develop and improve our Service. Where we retain information for Service improvement and development, we take steps to eliminate information that directly identifies you, and we only use the information to uncover collective insights about the use of our Service, not to specifically analyze personal characteristics about you.  


ii.      Information You Share on The Service


If your account is deactivated or disabled, some of your information and the content you have provided will remain in order to allow your team members or other users to make full use of the Service.  For example, we continue to display messages you sent to the users that received them and continue to display content you provided.


iii.    Managed Accounts


If the Service is made available to you through an organization (e.g., your employer), we retain your information as long as required by the administrator of your account.


iv.    Marketing Information


If you have elected to receive marketing emails from us, we retain information about your marketing preferences for a reasonable period of time from the date you last expressed interest in our Service, such as when you last opened an email from us or ceased using your registered account.  We retain information derived from cookies and other tracking technologies for a reasonable period of time from the date such information was created.


6.      How to Access and Control Your Information


You have certain choices available to you when it comes to your information. Below is a summary of those choices:


(a)   Access and Update Your Information


Our Service give you the ability to access and update certain information about you from within the Service. You can update your account information and modify content that contains information about you using the editing tools associated with that content.


(b)   Deactivate Your Account


If you no longer wish to use our Service, you or your administrator may be able to deactivate your Service account. If you can deactivate your own account, that setting is available to you in your account settings. Otherwise, please contact your administrator. If you are an administrator and are unable to deactivate an account through your administrator settings, please contact us.  Please be aware that deactivating your account does not delete your information, where your information remains visible to other Service users based on your past participation within the Service.  For more information on how to delete your information, see below.


(c)   Delete Your Information


We remind you that you have a right to have your personal information deleted at any time. As such, our Service give you the ability to delete certain information about you from within the Service. For example, you can remove content that contains information about you. Please note, however, that we may need to retain certain information for record keeping purposes, to complete transactions or to comply with our legal obligations.   


(d)   Request That We Stop Using Your Information


In some cases, you may ask us to stop accessing, storing, using and otherwise processing your information where you believe we don’t have the appropriate rights to do so. When you make such requests, we may need time to investigate and facilitate your request. If there is delay or dispute as to whether we have the right to continue using your information, we will restrict any further use of your information until the request is honored or the dispute is resolved, provided your administrator does not object (where applicable).  


(e)   Opt-Out of Communications


You may opt out of receiving promotional communications from us by using the unsubscribe link within each email, updating your email preferences within your Service account settings menu, or by contacting us as provided here to have your contact information removed from our promotional email list or registration database.  You understand and agree that, even if you opt-out, you will continue to receive legal notices from us, including any changes to our Terms and Conditions and Privacy Policy. You will also continue to receive messages, confirmations or other information in response to any direct request that you make to us or relating to any transactions you initialize, process or complete on or through our Service and website.


7.      Other Important Privacy Information


(a)   Notice to End Users


Our Service is intended for use by organizations. Where the Service is made available to you through an organization (e.g. your employer), that organization is the administrator of the Service and is responsible for the accounts and/or Service website over which it has control. If this is the case, please direct your data privacy questions to your administrator, as your use of the Service is subject to that organization’s policies. We are not responsible for the privacy or security practices of an administrator’s organization, which may be different than this policy.


Administrators are able to:


i.        require you to reset your account password;

ii.      restrict, suspend or terminate your access to the Service;

iii.    access information in and about your account;

iv.    access or retain information stored as part of your account;

v.      change the email address associated with your account;

vi.    change your information; and

vii.  restrict your ability to edit, modify or delete information


Even if the Service is not currently administered to you by an organization, if you use an email address provided by an organization (such as your work email address) to access the Service, then the owner of the domain associated with your email address (e.g. your employer) may assert administrative control over your account and use of the Service at a later date. You will be notified if this happens.


If you do not want an administrator to be able to assert control over your account or use of the Service, use your personal email address to register for or access the Service.  If an administrator has not already asserted control over your account or access to the Service, you can update the email address associated with your account through your account settings.  Once an administrator asserts control over your account or use of the Service, you will no longer be able to change the email address associated with your account without administrator approval.

(b)   Fraud


We take fraud seriously. It is a crime to subscribe for Service with a false name or with the use of an invalid credit card, which is created for the sole purpose of purchasing items illegally or using a credit card or its information, via theft or unauthorized use. It is also illegal to misuse the charge back process to take advantage of merchants. If you are a perpetrator of fraud, be aware that we will actively pursue and prosecute fraud offenders to the fullest extent of the law.


Although most fraud offenders use free email services and false names, many are not aware that their web browser transmits a unique Internet address to us which can be used by law enforcement officials to identify and locate them. We will work with cardholders, credit card companies, and enforcement authorities to pursue fraud offenders.


(c)   Anti-Spam Policy


We are 100% opposed to unsolicited commercial email ("spam"). We do not have any desire to send unsolicited marketing emails to anyone without permission and we do not sell or provide user email addresses to any unauthorized third party in violation of this Privacy Policy. All of our newsletters and other general email marketing communications also include an "unsubscribe" opt-out link that you may use to ask that we discontinue such emails to you.


(d)   Do Not Track Signals


We do not currently incorporate a self-regulatory protocol with regard to Internet browsers using "Do Not Track" signals nor do we impose any protocol on third parties with whom we may share user data.


(e)   Our Policy Towards Children


Our Service and website are not designed or intended for use by children under age 18. At various places on our Service and website, we may ask users for their age. Children under age 18 are expressly prohibited from submitting any Personally Identifiable Information to us, and if we discover that we have inadvertently gathered any such information from a child under age 18, we will take appropriate steps to delete it. If you are under age 18, you should use our Service and website only with the involvement of a parent or guardian.


(f)    Acceptance of Our Privacy Policy


When you use our Service and website, you are accepting the terms and conditions of this Privacy Policy, and we will have the right to use your Personally Identifiable Information or other information about you as described in this Privacy Policy. If you do not agree to have your information used in any of the ways described in this Privacy Policy, you must not use our Service and website, and you must follow the opt-out provisions above. (g)   Changes to Our Privacy Policy


From time to time, we may revise this Privacy Policy to reflect industry initiatives, changes in the law or technology, or changes in our practices regarding information collection and use. Any changes to this Privacy Policy will become effective upon posting of the revised Privacy Policy on the Internet, accessible through our website. By continuing to use our Service and website, following such changes, you will be deemed to have agreed to such changes. If you do not agree with the terms and conditions of this Privacy Policy, as it may be amended from time to time, please do not continue using our Service and website. As we said, ACSB takes protecting your privacy very seriously. To make sure your personal information is secure, we communicate these guidelines to our employees and strictly enforce privacy safeguards within our company.


(i)     Applicable law


The interpretation and application of this Privacy Policy shall be governed by the laws of the Malaysia without regard to its conflict of law provisions.
